What is Partita IVA, how it differs from a Russian individual entrepreneur (IP), and why you can’t renew a residence permit in 2026 without it?

Partita IVA (P.IVA) is the Italian tax identification number for carrying out self-employment. It’s analogous to a Russian IP, but with important differences: it’s opened through an accountant (commercialista), tied to a specific activity (ATECO code), and the chosen tax regime determines everything — from tax rates to pension contributions.

When to open it — deadlines and pitfalls in 2026

Can you open P.IVA before getting the permesso? And what happens if you miss the December 31 deadline?

Deadline: December 31 of the year you arrive

If you arrived in Italy and did not open a P.IVA before year-end — you lose the possibility to show Italian income for that entire tax year. This is critical for residence permit renewal. You can register income retroactively, but you cannot open a P.IVA retroactively.

What you need BEFORE opening a P.IVA

Codice Fiscale

It can be obtained before the permesso if you have a type D visa + ricevuta (art. 6 DPR 605/1973). Detailed instructions in our article.

Residenza (residence registration)

For Lavoro Autonomo by law — only after obtaining the permesso. Formally, Forfettario requires residenza. More below.

Permesso di soggiorno (recommended)

Technically possible with a ricevuta, but many accountants refuse to work without the permesso. With the permesso — it’s easier.

Residenza and Forfettario — a closed loop

For Forfettario you need residenza, but residenza for Lavoro Autonomo is only after the permesso. What to do?

This is one of the main traps for immigrants with Lavoro Autonomo.

Three scenarios

Wait for the permesso (the correct path)

Get the permesso → register residency → open P.IVA on Forfettario. Risk-free, but can take 3–16 months (depends on the city).

Open on Ordinario (safe compromise)

Open P.IVA on the ordinary regime (IRPEF 23–43%) without residenza. Pay higher taxes, but legally. Then switch to Forfettario after obtaining residency.

Open Forfettario without residenza (risky)

A popular but risky route. Small communes sometimes register residency before the permesso, though by law they shouldn’t. The tax office may issue additional assessments in 2–7 years.

If you opened Forfettario without residenza and the tax office audits — you’ll have to pay the difference between Forfettario and IRPEF for all years + penalties.

Step-by-step process to open P.IVA in 2026

Find a commercialista (accountant)

They will file the Communicazione Unica — the single form that creates records in the Agenzia delle Entrate, INPS and Camera di Commercio at once. More on choosing an accountant at the end of the article.

Choose an ATECO code

The type of activity. It determines the profitability coefficient (how much tax you pay) and whether registration in the Chamber of Commerce is required. More below.

Choose the tax regime

Forfettario (5–15%) or Ordinario (IRPEF 23–43%). For most freelancers Forfettario is more advantageous.

Make sure the accountant ticks "nuova attivita" for the 5% rate. If they don’t — it will be 15% and cannot be changed.

Register with INPS (Gestione Separata)

Mandatory for freelancers. The accountant includes this in the Communicazione Unica. Rate ~26% of income — more below.

Check all documents personally

Request the AA9/12 module (the opening form). Check the rate (5% vs 15%) in the LM module of the declaration. Ask for a copy of the submitted document.

How long it takes

Opening a P.IVA — 1–3 days through an accountant. Opening fee: from 0 to 200 EUR (many do it for free with a service contract).

ATECO code — the choice that defines everything

What is an ATECO code and why does it determine the real tax amount?

ATECO code (analogous to the Russian OKVED) defines the type of activity. But in Italy it affects much more: the profitability coefficient under Forfettario, the need to register with the Chamber of Commerce, and the size of INPS contributions.

For IT freelancers: Chamber of Commerce is not required

With ATECO 62.xx (IT) registration in the Chamber of Commerce is not necessary. But the questura during renewal may ask for an explanation. Prepare justification in advance with a link to ateco.infocamere.it.

INPS: the hidden ~26% nobody mentions

Everyone says “5% tax in Forfettario”. Why is the real burden ~25%?

The 5% tax is supplemented by INPS contributions of ~26% on the same taxable base. Total effective burden: ~25–26% of turnover. This is still less than IRPEF (35–45%), but far from just “5%”.

Gestione Separata INPS

Mandatory registration for freelancers on P.IVA. Rate ~26.07% of taxable income. Paid in advance in June and November (via F24). Entitles you to state healthcare (SSN) and pension.

INPS discounts in the first years

For businesses opened in 2025–2026: the pension contribution in the first year is 2,250 EUR instead of 4,500. For artigiani there’s a 35% discount for the first 5 years. Ask your accountant about available reductions.

The Forfettario pension trap

If you spend your whole career in Italy on Forfettario — your pension may only cover ~7 months per year. INPS may say: “you didn’t earn the rest.” More details — in the Forfettario article.

Which bank account is needed for P.IVA in 2026

?

Is a business account mandatory? And how to pay F24 (taxes)?

A business account is formally not required for Forfettario. But you need a bank that supports F24 payments.

Invoices to clients: fattura elettronica in 2026

Since 2024 electronic invoicing is mandatory for everyone, including Forfettario.

  • Sent through the SDI system (Servizio di Interscambio)
  • Invoices should state: “Regime forfettario: operazione fuori campo IVA”
  • VAT is not charged to clients (an advantage for foreign clients)
  • Services: Fiscozen (automation), accountant’s built-in features, tax authority personal area

Irreversible mistakes when opening P.IVA

The accountant didn’t tick "nuova attivita". Cannot be changed retroactively. Loss: ~3,900 EUR/year on 50,000 EUR turnover. Check the LM module personally.

Affects the profitability coefficient (40% vs 78% = huge tax difference). It can be changed, but it attracts the tax office’s attention.

How to check your accountant’s work

Request the LM module submitted with the declaration — it shows the rate (5% or 15%). Get free initial consultations from 2–3 online accountants before choosing. If something seems wrong — a second opinion can save thousands of euros.

It’s technically possible to open a VAT number (Partita IVA/P.IVA) before getting a permesso di soggiorno (residence permit) — they can set it up with a ricevuta and a codice fiscale (tax code). But for non-residents tax rates are significantly higher and there are no tax breaks. So it’s better to wait to open it until you have the documents.
