I’m a bit confused about the EB-2 NIW petition. Prong 1, 2, 3 — are these three separate parts of the petition or something else? What exactly is included in each? I’m handling this myself without a lawyer, so I want to understand how it all works.
To qualify for EB-2 NIW you need either education (advanced degree) or 3 of 6 criteria — that gives you the right to apply for EB-2. Then your project is evaluated under the three prongs to determine whether it’s an NIW or not. So the prongs are the second step; they’re not about qualifying for EB-2, they’re about the waiver.
