To get the 5% rate, you need to meet the “nuova attivita” condition - new business activity. This means you haven’t carried out similar work as an employee or self-employed in the previous 3 years.

CRITICAL MISTAKE - cannot be corrected

If your commercialista (accountant) didn't mark "nuova attivita" when opening your P.IVA and set the rate at 15% instead of 5% - changing this retroactively is IMPOSSIBLE. Even in subsequent years, the rate stays at 15%. The rate is only visible in the already-submitted tax return (module LM). Verify this personally - request the submitted module from your accountant.

Important: INPS is deductible from your tax base

INPS (social security) contributions can be deducted from taxable income the following year. The actual numbers will be slightly lower than shown - your commercialista (accountant) will calculate the exact amounts.

Who can use the Forfettario regime

Meanwhile, you need to show a minimum income to renew your residence permit. Don't move to Italy in November-December if you're planning to use the Forfettario regime.

For Lavoro Autonomo holders, residenza is legally available only after receiving your permesso. Without residenza, you technically cannot open Forfettario. Some small municipalities will process it earlier - but that's luck, not the rule.

Important: if you open a P.IVA under Forfettario without residenza - the tax agency may send you a reassessment and fine 2-7 years later.

Your accountant will file the Communicazione Unica - a unified form that simultaneously creates entries at the Agenzia delle Entrate (tax agency), INPS (social security), and Camera di Commercio (Chamber of Commerce, if applicable).
